Oh Boy
Before I get myself into a dung heap of trouble, let me just say that I am like the scorpion that the frog, albeit foolishly, took across the river; it’s just my nature. Or, to wax more eloquently in the words of Thomas Paine “If there must be trouble, let it be in my day, that my child will have peace.” Now, let us begin the beguine.
This disquisition is going to get knee deep in voodoo. Try to keep up, before you throw up as I let my freak-flag fly. Wave on, baby.
IF 6 Was 9
In 1967, legendary guitarist Jimi Hendrix’s tune “If 6 was 9" was released. He would leave this world less than three years later. More than a brilliant and ordained musical talent, Hendrix was also clairvoyant. This clairvoyance is showcased in the lyrics of the song’s bridge:
“White-collared conservative flashing down the street
Pointing their plastic finger at me, huh
They're hoping soon my kind will drop and die
But I'm gonna wave my freak flag high, high, oh
Wave on, wave on.”
How poignant and prescient. And for the “record” my favorite number is 69. Go figure, dirty minded soul. It simply is my nature much like the fabled scorpion.

Smitty’s Twin Cancers
In the late 60’s, when Hendrix released “If 6 was 9” I was just about to start kindergarten, but I remember adults always talking about “signs.” Remember that was a very different time, full of rebellion, turmoil (foreign and domestic), drugs and “free love.” Though in my experience, love is never “free” no matter what kind it is. Jimi likely had a different experience. In fact, I’d make book on it.
In any event, I recall hearing the adults ask each other “So what’s your sign?” I wonder how many people got laid because of their “sign.” Incalculable, I am certain. I warned that this was going to get deep. Thusly, I preemptively appear before thee in sackcloth and ashes.
Astrologically, Donald “Smitty” Trump is a Gemini (twins, duality). His Gemini Sun sign is combined with the sign of Cancer through various planetary placements. Good lord is there not a parable there. A cancerous dualistic personage that, in his case, is also malignant. The zodiac symbol/glyph for Cancer is what appears to be a horizontal 69, it is also represented by a crab. Oh happy day.
Fear not, no need for me to do what you already have, rascal.
The Twins: Smitty’s “US” Is Supreme Court
Whether one accepts the reality, or not, Smitty is likely the most consequential “US” president in modern history, certainly in my lifetime, for a plethora of reasons. He not only has a twin, in the incarnation of an entity known as the Supreme Court, he has clones. His most potent clone is also his Gemini twin; the aforementioned entity and branch of government. That is the unadulterated truth and that is why he is consequential.
Truth and consequences.
Ideally, the Supreme Court was designed to be insulated from political influence, but in practice, it is not. Not by a long shot. While justices are appointed for life and not subject to direct political pressure from voters, their appointments are inherently political, and their decisions often reflect political ideologies. Dangerous stuff.
The guarantee of life tenure for SCOTUS judges aims to protect them from political pressures and allow them to rule based on the law without fear of reprisal. However, Smitty is a cowardly and vindictive individual that appointed cowardly and vindictive justices and the Supreme Court has become increasingly polarized. The Supreme Court's power to strike down laws passed by elected officials has lead to accusations that it is acting against the will of the majority.
Judges are supposedly expected to adhere to ethical guidelines that emphasize impartiality and the avoidance of conflicts of interest. Theoretically, the Court's decisions are to be based on legal interpretation and the Constitution, not on political considerations. While the Supreme Court is designed to be independent, it is not immune to political influence, both in its composition and in the way its decisions are perceived. The Court's “legitimacy” (what a jape) rests on its ability to maintain public trust by demonstrating impartiality and adherence to the law.
So much for that.
If Six Was Nine
There are nine supreme court justices and I can name every one of them. I can tell you who appointed them and I can tell you their “judicial temperament.” Since Smitty’s encore as both a second and first term president (technically) the court has unashamedly made not scholarly and independent legal decisions, but political ones. Did I mention this was dangerous stuff?
The court is now what is known as a six-to-three court. Six out of the nine political hacks either appointed by Smitty, afraid of Smitty or think like Smitty. Did I mention this was dangerous stuff?
In less than six months in the White House, Smitty’s geminiacal twin has repeatedly ruled 6-3. A court with individuals that have some serious issues and biases; personal and otherwise. What does this portend?
Well, let’s see.
Trump v. CASA, Inc.- Nationwide injunctions & birthright citizenship:
Limited lower courts' ability to issue nationwide injunctions; did not rule on constitutionality of ending birthright citizenship. The court split: 6–3 (Barrett, Roberts, Thomas, Alito, Gorsuch, Kavanaugh in majority; Sotomayor, Kagan, Jackson dissenting). This ruling was a major win for Trump. The Court emphasized judicial restraint, but critics argue it weakens checks on executive overreach.
Kennedy v. Braidwood Management, Inc.- Preventive care under Obamacare:
Upheld the authority of the HHS task force to mandate insurance coverage for preventive services. The court split: 6–3 (Kavanaugh wrote majority). This ruling preserved key ACA provisions. Conservatives dissented, citing separation of powers concerns.
Free Speech Coalition v. Paxton- Age verification for pornographic websites:
Upheld Texas law requiring age verification for adult content. The court split: 6–3 (Thomas wrote majority). Framed as protecting minors; dissenters warned of First Amendment overreach.
Mahmoud v. Taylor- Religious opt-outs in public schools:
Allowed parents to remove children from classes with LGBTQ+ content. The court split: 6–3. Seen as a religious liberty win by conservatives; dissenters warned of undermining inclusive education.
FCC v. Consumers' Research- Universal service fund for internet/phone subsidies:
Upheld FCC’s funding mechanism for broadband access. The court split: 6–3 (Kagan wrote majority). A rare liberal-authored opinion with conservative dissent. This ruling preserved funding for rural and low-income connectivity.
Medina v. Planned Parenthood South Atlantic- Medicaid provider exclusions:
Allowed states to exclude providers like Planned Parenthood from Medicaid. The court split: 6–3 (Gorsuch wrote majority). This ruling expanded state power over Medicaid; dissenters warned of reduced access to care for low-income patients.
Trump v. ICE Deportation Policy- Deportation to third countries:
Allowed fast-track deportations without notice or objection. The court split: 6–3. Critics say it erodes due process and endangers immigrants; supporters cite national security and enforcement efficiency.
There Is More Judicial Constructionism Ahead
If only six was nine.
The farce of all American institutions is truly on display in its death spiral. I guess the branch that started as a petty power trip by some old bastards isn't actually the highest standard of judicial intelligence 🙂
